DEVELOPMENT PLANNING CONSIDERATIONS

Building in a foreign country can be scary for someone unfamiliar to the process. Luckily, Desmond Construction Consulting Services is very familiar with the different government departments and regulations involved with construction in Costa Rica. Our help will give you the security and peace of mind that you are building your home in accordance with government code. Here is a brief tutorial of the process we will help you through:

  • Recording your Property – Foreigners enjoy the same rights as Costa Ricans. Land is recorded in the National Public Property Registry located in San Jose.
  • Surveying the Land – A survey map of the land is required for registering property which indicates its exact location and boundaries.
  • Zoning Issues – Maritime Zoning Law regulates 200 meters inland of all pacific and Atlantic coastlines. Land concessions can be granted for the “Restricted Zone” 150 meters after the first 50 meters of “Public Zone”
  • Water Concerns – Water access is a vital factor to consider with properties. All water usage is controlled by government permits granted from two principal agencies, MINAE and AyA (see below)
  • Environmental Approval – All development must be reviewed by SETENA (see below) to ensure sustainability. This can be a time consuming process depending on the size and usage of the property and requires case specific attention.
